Employment Discrimination

Representing employees in cases involving workplace discrimination, harassment, retaliation, and violations of employment laws.

Employees are entitled to fair treatment in the workplace and to protection from unlawful discrimination, retaliation, and other illegal conduct. FitzGerald Law represents workers who have been treated unfairly because of protected characteristics or because they exercised their legal rights.

An employment discrimination case generally involves whether an employee suffered an adverse employment action—such as termination, demotion, unequal pay, harassment, failure to hire, or denial of promotion—because of race, sex, age, disability, religion, national origin, or another protected status. These cases may also involve retaliation for reporting misconduct, requesting accommodation, or participating in protected activity.

The evidence in these matters often includes personnel records, comparative treatment, internal complaints, workplace communications, disciplinary history, witness testimony, and the employer’s stated reasons for its actions. The core legal questions are often whether the employer’s explanation is legitimate, whether discrimination or retaliation was a motivating factor, and what damages or other remedies are appropriate.
